Update..
called bank , had to open up a claim and their legal department is going to investigate it after I fax the info they send to me back to the legal dept.
They said they would " Temparily credit " my account the amount .

You bank should be contacting them for info on your order. When they state you never ordered as they are telling you, then your bank will go ahead and allow you to keep the "temp" credit they issued. If this place states to the bank that you ordered, then they will have to show they shipped it.. then you will probably get your order. Chances are, you will just get to keep your credit.
