Pa. woman wins complaint against Kmart over tax on toilet paper

MONROEVILLE, Pa. - A western Pennsylvania woman won $100 plus court costs after she sued Kmart for twice collecting sales tax on a nontaxable necessity: toilet paper.

Mary Bach, of Murrysville, said Kmart offered to settle the case out of court before a Thursday hearing at which a Monroeville district judge sided with her. But the settlement required her to sign a confidentiality agreement, which would have defeated the purpose of her suit, Bach said.

"I want consumers as they shop during the important holiday to be aware of what is and what isn't taxable," Bach said after the verdict. "I would lose my ability to spread that message if I were gagged."

Bach sued in October after a Kmart store in Monroeville twice collected a 7 percent tax , 28 cents , when she bought a 12-roll package of toilet paper for $3.99.

Although most paper goods are taxable in Pennsylvania, toilet tissue is listed as a nontaxable item by the state Department of Revenue.

Kmart, a unit of Sears Holdings Corp., will not appeal the verdict.

"We don't want to fight with our customers," Kmart spokeswoman Kim Freely said. "We apologize for the inconvenience and the problem is being corrected."

Bach said shoppers "need to look at every line" on sales receipts when they shop.

Bach brought the suit under the state's Unfair Trade Practices and Consumer Protection Law. Plaintiffs can sue for the amount of the damages or $100, whichever is more.

shoot you beat me to it. I just read it and I love it!

If you google her name, she has done this quite a few times in the past, always successfully. Glad there are people like her out there.

I may need to chat with this lady! I need to know what law I can sue Walmart under for never scanning all my coupons! I usually have two of each coupon when I print them (bricks...), and they always seem to miss one. I know they stick together so I always crinkle them up a bit first. Doesn't matter -- they still don't scan them. :p I usually realize it when I get home and look at my receipt. I have tried to call the store or go back up there to correct the issue, and every manager I've talked to says "I can't do anything about that." They've cost me at least 20-30 bucks in the last couple months from this. :eek:

I always check my receipts very closely. A few months ago, I bought several items at Walmart and my total was like $80.00 or so. I was distracted by my kids, and not paying close attention when I paid. When I got to the car, I checked my receipt, and a cake I bought for $4.00 rang up for $71.00!! Quite a difference! I went back in and got the difference back, and learned to pay closer attention at the register!

uhh i usally watch also .. but yankee candle got me.. this past wkend .. spent 100.00 in there and well.. they did not take my coupon off i dont remember if it was the b1get1 free of if it was buy one get 10 off.. so how am i to go in and fight that one. uhhggg

I always round off the amounts so I have a general idea of what the total will be. As for not taking off the coupon, I would go back and ask them to take it off and if they don't I would return everything and rebuy them. I know this would take time, but you must stand your ground.

I always do that too so I have a general idea what the total should be. I can't imagine being charged $71 for an item that was $4 and not realizing something was wrong until I got to my car and looked at the receipt! :eek:
